This Service acts as a digital disposable camera and shared event album platform. By accessing or using the Service as a host, guest, or viewer, you agree to the collection and use of your information in accordance with this Privacy Policy. If you do not agree, please do not use the Service.

Integration with Terms: This Privacy Policy is incorporated into and subject to our Terms of Service, including all disclaimers, limitations of liability, and binding arbitration clauses contained therein.

2. Information We Collect

We strictly collect only the data necessary to provide the Service. Depending on your role, we may collect the following:

Host Data: Email address, account settings, event metadata (names, dates, settings), and payment status (processed securely via Stripe).
Guest Data: Email addresses (if required for access), device and browser metadata, IP addresses, and uploaded photographs.
Usage Data: Upload status, QR code/link scans, error logs, and basic diagnostics to ensure the Service functions correctly.

No Biometric Data: We do not use facial recognition technology. We do not scan photographs to extract biometric identifiers, and we do not collect, process, or store biometric data under any circumstances.

3. How We Use Your Information

We use the collected information exclusively to:

Operate and maintain the Service.
Process photo uploads, apply digital filters, and generate shared event albums.
Provide host controls, including manual event deletion.
Prevent abuse, troubleshoot errors, and monitor Service stability.
Process payments and comply with legal obligations.

We do not sell your personal information or event photos to third parties, nor do we use private event photos for unrelated marketing or advertising.

4. How Information is Shared

Because the core feature of the Service is shared event photography, your data is inherently shared in the following ways:

With the Host: Event hosts have administrative access to view and download all photos uploaded to their specific event.
With Event Guests: Once the event album is revealed, photos may be visible and downloadable to anyone who possesses the shared album link. Hosts are solely responsible for distributing these links safely.
With Service Providers: We use trusted third-party infrastructure to run the Service, such as Cloudflare/R2 for robust cloud storage and delivery, and Stripe for payment processing. These providers process data strictly on our behalf.
For Legal Reasons: We may disclose information if required by law, subpoena, or if we believe in good faith that such action is necessary to protect the rights, property, or safety of MiKosBros LLC, our users, or the public.

5. Data Retention and Immediate Deletion

We believe in minimizing data storage. Our retention schedules are as follows:

Free Events: Albums and associated photos are scheduled for automatic deletion 7 days after the album reveal time.
Paid Events: Albums and associated photos are scheduled for automatic deletion 30 days after the album reveal time.
Immediate Host Deletion: Hosts have absolute control and may manually delete an event from their dashboard at any time. This action instantly and permanently deletes the event, database records, and all associated photos from our active cloud storage (including Cloudflare R2 buckets).

Minor, non-identifiable traces may temporarily remain in secure automated backups or payment logs where legally or operationally required.

6. Security and Assumption of Risk

We employ commercially reasonable technical and organizational measures designed to secure your data. However, the internet is not a 100% secure environment. No service provider, storage infrastructure, or upload stream can guarantee absolute security.

Disclaimer: To the maximum extent permitted by law, MiKosBros LLC disclaims all liability for any unauthorized access, use, disclosure, alteration, or destruction of data or photographs. You use the Service entirely at your own risk.

7. Children's Privacy

The Service is not directed to, nor do we knowingly collect personal information from, children under the age of 13 (or the applicable age of digital consent in your jurisdiction). Hosts are solely responsible for ensuring they have appropriate parental or guardian consent before allowing minors to use the Service or capturing photos of minors.

8. International Data Transfers

MiKosBros LLC is based in the United States. If you access the Service from outside the U.S., your data may be transferred to, stored, and processed in the U.S. or other locations where our infrastructure providers operate. By using the Service, you consent to these transfers.

9. Dispute Resolution and Class Action Waiver

Any dispute related to privacy or data security is subject to the Dispute Resolution, Binding Arbitration, and Class Action Waiver clauses explicitly outlined in our Terms of Service. By using the Service, you agree to resolve disputes strictly through individual arbitration and waive your right to participate in a class action lawsuit.

We reserve the right to modify this Privacy Policy at any time. Any changes will be posted on this page with an updated "Effective date." Your continued use of the Service after changes are published constitutes your acceptance of the revised Privacy Policy.
